Welcome to Dish Finder Co ("Dish Finder Co," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our website and services, including any content, features, and functionality available at or through https://www.dishfinder.co (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Who we are

The Services are operated by Dish Finder Co (the "Company"), a media company based in Toronto, Ontario, Canada, that publishes restaurant reviews and related content focused primarily on the Toronto area.


2. Eligibility & your responsibilities

2.1 Eligibility

  • You must be at least 13 years old to use the Services.

  • If you are under the age of majority in your place of residence, you may only use the Services with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

By using the Services, you represent that you meet the above requirements and that you have the capacity to enter into a binding agreement with us.

2.2 Your responsibilities

You agree that you will:

  1. Use the Services only for lawful purposes and in accordance with these Terms;

  2. Not use the Services:

    • To violate any applicable law or regulation;

    • To harass, threaten, or abuse others, or to post defamatory, obscene, hateful, or otherwise objectionable content;

    • To infringe the intellectual property, privacy, publicity, or other rights of any person;

    • To distribute spam, junk mail, or any form of unsolicited communication;

  3. Not attempt to:

    • Interfere with or disrupt the operation or security of the Services;

    • Use any automated system (including "robots," "spiders," or "scrapers") to access the Services, except for standard search engine technologies;

  4. Not attempt to gain unauthorized access to any part of the Services, accounts, or systems.

We may, in our sole discretion, restrict or terminate your access to the Services if we believe you have violated these Terms.


3. Accounts, if applicable

From time to time, we may allow you to create an account (for example, to leave comments, save favorites, or subscribe).

If you create an account:

  • You must provide accurate and up-to-date information;

  • You are responsible for maintaining the confidentiality of your login details;

  • You are responsible for all activity that occurs under your account;

  • You agree to notify us promptly via dishfinder.co/contact of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time and for any reason, including violation of these Terms.


4. Content on the Services

4.1 Editorial content & restaurant reviews

The Services provide restaurant reviews, opinions, rankings, guides, and other editorial content.

  • All such content is subjective in nature and reflects the opinions and experiences of our writers or contributors at a particular point in time.

  • We do not guarantee that any restaurant, menu item, price, hours of operation, or other information mentioned on the Services will be current, accurate, or available when you visit.

  • We are not affiliated with most restaurants we mention unless explicitly stated. A mention, rating, or review is not a guarantee, endorsement, or warranty of any restaurant or product.

You should always verify information directly with the restaurant or provider before making plans or purchases.

4.2 User submissions (e.g., comments, photos)

We may allow you and other users to submit or post content to the Services, such as:

  • Comments, feedback, or reviews;

  • Photos or other media;

  • Suggestions or other materials.

Collectively, this is "User Content."

You are solely responsible for your User Content. By submitting User Content, you represent and warrant that:

  • You own or have all necessary rights to your User Content;

  • Your User Content does not infringe any copyright, trademark, trade secret, privacy, publicity, or other rights of any person;

  • Your User Content complies with these Terms and all applicable laws.

We do not undertake to pre-screen all User Content. We may, but are not obligated to, remove or modify User Content at our sole discretion, including if we believe it violates these Terms or is otherwise inappropriate.

4.3 License you grant to us for User Content

You retain any ownership rights you have in your User Content.

By submitting or posting User Content on or through the Services, you grant Dish Finder Co a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content for the purpose of operating, promoting, and improving the Services, and for marketing and archival purposes.

This license lasts for as long as your User Content is available on the Services and for a reasonable period thereafter for backup, archival, or legal purposes, subject to applicable law and our Privacy Policy.

Nothing in these Terms is intended to limit any non-waivable moral rights you may have under applicable law.


5. Use of third-party images (including Google Places)

5.1 Google Places and other third-party imagery

We may display images of restaurants and locations that are provided by third parties, including:

  • Google Places / Google Maps;

  • Other third-party platforms or content providers;

  • User-submitted photos.

Where we use such third-party images:

  • The copyright remains with the original owner or provider of the image.

  • We will make reasonable efforts to display any required attribution or credit as specified by the source (for example, under Google's attribution guidelines).

  • To improve performance, we may temporarily cache certain images (including images obtained through the Google Places API) on our servers for up to 24 hours per request, in accordance with applicable API terms.

If you are a rights holder and believe that an image or other content displayed on the Services infringes your rights, please contact us via dishfinder.co/contact with:

  • Your name and contact information;

  • A description of the content and its location on the Services;

  • A statement that you are the rights holder or authorized to act on their behalf;

  • A description of the requested action (e.g., remove, update attribution).

We will review and respond within a reasonable time.


6. Intellectual property rights

6.1 Our content

Except for User Content and third-party content as described above, all materials on the Services, including text, articles, reviews, graphics, logos, design, and layout (collectively, "Dish Finder Content"), are owned by or licensed to Dish Finder Co and are protected by copyright, trademark, and other laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.

You must not:

  • Copy, reproduce, modify, distribute, sell, or create derivative works from Dish Finder Content, except as permitted by applicable law or with our prior written consent;

  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices.

6.2 Trademarks

All names, logos, and other marks used on the Services that identify Dish Finder Co or the Services are trademarks or trade dress of Dish Finder Co. Other product and company names mentioned may be trademarks of their respective owners.

You may not use any of our trademarks without our prior written permission.


7. Third-party links & services

The Services may contain links to third-party websites or services (such as restaurant sites, map services, reservation platforms, or social networks).

  • These third-party sites are not controlled by us.

  • We are not responsible for their content, policies, or practices.

  • Accessing such third-party sites is at your own risk and subject to the terms and policies of those third parties.

A link or reference to a third-party product, service, or site does not constitute an endorsement or recommendation by Dish Finder Co.


8. Privacy & cookies

Your use of the Services is also governed by our Privacy Policy and any cookie policy we may maintain (collectively, the "Privacy Policies"), which describe how we collect, use, and disclose information about you.

By using the Services, you consent to our collection and use of your information as described in the Privacy Policies.

9. Disclaimers

To the fullest extent permitted by applicable law:

  1. No professional advice.
    The content on the Services is for informational and entertainment purposes only. It is not professional, legal, health, financial, or any other type of advice. You are responsible for your own decisions and should seek appropriate professional advice when needed.

  2. No guarantee of accuracy.
    We try to keep information (such as restaurant details, pricing, hours, menus, and ratings) accurate and up to date, but we do not guarantee that any information is complete, accurate, current, or suitable for your purposes.

  3. Services provided "as is" and "as available."
    The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  4. No guarantee of availability.
    We do not guarantee that the Services will be uninterrupted, secure, or free of errors, defects, or harmful components, or that any issues will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the exclusions will apply only to the extent permitted by applicable law.


10. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall Dish Finder Co or its owners, directors, employees, or agents be liable for:

  • Any indirect, incidental, consequential, special, or punitive damages;

  • Any loss of profits, business, goodwill, data, or other intangible losses;

  • Any damages arising from:

    • Your use of or inability to use the Services;

    • Any content or conduct of any third party on or off the Services;

    • Any errors or omissions in the Services;

    • Any restaurant visit, meal, purchase, or experience you undertake in reliance on the Services.

Where our liability cannot be excluded under applicable law, and to the extent permitted, our total aggregate liability to you for any claims arising out of or relating to the Services or these Terms will be limited to CAD $100.

Some jurisdictions do not allow limitations on certain types of damages, so some of the above limitations may not apply to you. In such cases, the limitation will apply only to the extent permitted by applicable law.


11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dish Finder Co and its owners, directors, employees, and agents from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services;

  • Your User Content;

  • Your violation of these Terms;

  • Your violation of any rights of another person or entity.


12. Termination

We may suspend or terminate your access to the Services (including any account you have) at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Services.

You may stop using the Services at any time. If you have an account, you may request that we disable or delete it by contacting us via dishfinder.co/contact.

Even after termination, certain provisions of these Terms will remain in effect, including but not limited to: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Governing Law and Dispute Resolution.


13. Changes to the Services

We may modify, update, or discontinue all or part of the Services at any time, with or without notice. We do not guarantee that the Services, or any content on them, will always be available or be uninterrupted.


14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page.

If we make material changes, we may provide additional notice (for example, by posting a prominent notice on the site or sending an email if we have your address).

Your continued use of the Services after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services.


15. Governing law & dispute resolution

These Terms and your use of the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

You agree that any dispute arising out of or in connection with these Terms or the Services will be brought exclusively in the courts of the Province of Ontario, located in Toronto, and you consent to the personal jurisdiction of such courts.

If you are a consumer residing outside Canada, you may have additional rights under mandatory consumer protection laws of your country of residence. These Terms are not intended to limit any such non-waivable rights.


16. Miscellaneous

  • Entire agreement. These Terms, together with our Privacy Policy and any other policies or guidelines we post from time to time, constitute the entire agreement between you and Dish Finder Co regarding the Services.

  • Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

  • No waiver. Our failure to enforce any right or provision in these Terms will not be deemed a waiver of such right or provision.

  • Assignment. You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, without your consent, including to any successor or purchaser of our business or assets.

  • Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
